Terms and Conditions governing the GXS FlexiLoan Balance Transfer Jan25 Cashback Campaign (“Promotion”)
By participating in the Promotion, you agree to the following terms and conditions, as may be amended by the Bank from time to time (“Terms”). Unless otherwise stated, all capitalised terms used in this Promotion shall have the meanings set forth in the GXS FlexiLoan Terms and Conditions or as otherwise defined elsewhere in these Terms. For the avoidance of doubt, “GXS FlexiLoan Terms and Conditions” as defined in these Terms include all the terms and conditions as set out in https://www.gxs.com.sg/flexiloan-terms, including the GXS FlexiLoan - Balance Transfer Terms and Conditions.
This Promotion is available from 10 January 2025 to 31 January 2025 (both dates inclusive) or such date(s) as may be determined by GXS Bank Pte. Ltd. (“GXS” or “Bank”) in its sole and absolute discretion (“Promotion Period”).
(a) Subject to Clause 2(b) below, you are eligible to participate in this Promotion if:
(i) you have received an invite from the Bank via the GXS app and/or an email from the Bank to your GXS-registered email address to participate in this Promotion;
(ii) your GXS FlexiLoan account remains active and in good standing with the Bank at all material times, including during the Promotion Period and until such time the Reward thereunder is fulfilled; and
(iii) you have performed a drawdown of a single GXS FlexiLoan Balance Transfer loan:
(b) You will not be an Eligible Customer if:
(i) any condition in Clause 2(a) has not been complied with;
(ii) any information which you have provided to the Bank during the GXS FlexiLoan application process has materially changed prior to drawdown of the loan; or
(iii) at any time during the Promotion Period or prior to fulfillment of the Reward, your GXS FlexiLoan account with the Bank is closed, suspended, cancelled or terminated (whether voluntarily or involuntarily), or you’ve breached any of the Terms of this Promotion or the GXS FlexiLoan Terms and Conditions.
(a) Under this Promotion, an Eligible Customer is eligible to receive, subject to the Terms of this Promotion, the cashback amounts set out in Clause 2(a)(iii) above (the “Rewards” and each a “Reward”).
(b) An Eligible Customer is eligible to receive one (1) Reward if they have successfully complied with the terms and conditions of the Promotion (“Successful Participant”), provided such customer has provided the Bank with full and accurate details and/or particulars.
(c) If more than one loan is drawn during the Promotion Period, the Reward will be awarded based on the loan with the higher cashback value. For example, if you draw a loan under Category 1 first, then subsequently draw another loan under Category 2, you will only be entitled to receive the Reward under Instalment Loan Category 2.
(d) The Reward(s) will be credited to a Successful Participant’s Main Account of the GXS Savings Account. You are to ensure that you have successfully opened a GXS Savings Account by 28 February 2025 and such account remains open until such time the Reward is credited into the account.
(e) Successful Participants will receive their Reward no later than 21 March 2025.
(a) Following the end of the Promotion Period, and/or upon such time that the Terms of the Promotion has been fulfilled, the Bank will provide the Successful Participants with details to redeem and/or use the Reward, and such conditions accompanying the redemption and/or use of the Reward from the supplier of the Reward or that the Reward has been credited to your GXS Savings Account. Only the Successful Participants will be notified.
(b) The Successful Participants shall accept their Rewards as it is and subject to any terms and conditions that may be imposed by the supplier of the Reward.
(c) The Successful Participants shall comply with such conditions of redemption and/or use stipulated by the supplier of the Reward, including the expiry of the Reward.
(d) The Rewards are available on a first-come first-served basis and may be limited in quantity and the Bank makes no guarantee on the availability of a Reward.
(e) The Rewards shall not be transferable, sold and/or exchangeable for cash, credit or any other items in part or in whole.
(f) The Bank shall not be liable to replace and/or compensate any Successful Participant for any Reward that has been lost, expired, and/or otherwise not credited, redeemed, collected or used in accordance with the terms and conditions.
(g) The Bank reserves the right to claw back the value of any Reward if it determines, at its sole and absolute discretion, that a customer has not fulfilled the terms of the Promotion and/or otherwise any misrepresentation, misconduct, fraud, and/or unfair or illegal conduct has been exhibited on the part of the customer at any time.
(h) The Bank makes no representation or warranty as to the quality or fitness for purpose, whether express or implied, of the Rewards.
(i) The Bank reserves the right to vary the cashback reward to another type of reward of equivalent or similar value.
(a) This Promotion is not valid with other offers or promotions unless otherwise stated. For the avoidance of doubt, all Eligible Customers for this Promotion may also participate in all other GXS FlexiLoan campaigns that are running during the Promotion Period if they have complied with the applicable terms and conditions thereunder, unless otherwise stated.
(b) The Bank may add to, amend, modify or vary any or all of these Terms at any time without notice or liability to any person.
(c) The Bank’s records and decisions on all matters relating to the Promotion (including but not limited to the eligibility of any person to participate in the Promotion, the awarding of any cashback, voucher or item or determination of any winner and the offer of any interest rate with respect to the GXS FlexiLoan) shall be final, conclusive and binding on all customers. We are not obliged to entertain any correspondence.
(d) In the event of any inconsistency between these Terms and any brochure, marketing or promotional material relating to the Promotion, these Terms shall prevail.
(e) The Bank, employees and/or independent contractors shall not be liable for any loss, liability, expense, damage and/or injury whatsoever or howsoever incurred or sustained by any person by reason of, arising from or in connection with the Promotion including the redemption or use of any good, service, product or facility of any merchant (if applicable) or for any other reason.
(f) The Bank is not responsible for any failure or delay in the transmission of any transaction by any party, including acquiring merchants, merchant establishments or any telecommunication provider.
(g) These Terms shall be governed by and interpreted in accordance with Singapore law, and you agree to submit to the exclusive jurisdiction of the Singapore courts.
(h) A third party who is not a party to these Terms shall have no rights under the Contracts (Rights of Third Parties) Act 2001 of Singapore to enforce or enjoy the benefit of any provision of these Terms.
(i) These Terms shall apply in conjunction with the GXS FlexiLoan Terms and Conditions and any other relevant terms as may be updated and/or notified by the Bank from time to time.
(j) The Bank reserves the right, at its sole and absolute discretion, to suspend, discontinue, extend and/or otherwise terminate the Promotion at any time without notice. The Bank shall not be liable for any damages, losses, claims or expenses arising from the suspension, discontinuance, extension and/or termination of any Promotion.
(k) The Bank reserves the right to reject any application, suspend, terminate or close any GXS FlexiLoan Account and/or change or vary any term of the GXS FlexiLoan offered (including the credit limits or any interest rate) at its sole and absolute discretion, including but not limited to if the Bank determines (at its sole discretion) that an Eligible Applicant has not fulfilled the terms of the Promotion and/or otherwise any misrepresentation, misconduct, fraud, and/or unfair or illegal conduct has been exhibited on the part of the Eligible Applicant at any time.
