Terms and conditions governing GXS FlexiCard Triple Rewards Referral Bonus Campaign (“Promotion”)
By participating in the Promotion, you agree to the following terms and conditions, as may be amended by the Bank from time to time (“Terms”). Unless otherwise stated, all capitalised terms used in this Promotion shall have the meanings set forth in the Card Account Terms or as otherwise defined elsewhere in these Terms.
This Promotion is available from 14 November 2024 to 31 December 2024 (both dates inclusive) or such date(s) as may be determined by GXS Bank Pte. Ltd. (“GXS” or “Bank”) in its sole and absolute discretion (“Promotion Period”).
a. Subject to Clause 2(b) below, you are eligible to participate in this Promotion if:
(i) you have received an invite from the Bank via the GXS app and/or an email from GXS to your GXS-registered email address to participate in this Promotion; or
(ii) you hold or maintain a GXS FlexiCard account that is active and in good standing during the Promotion Period;
(ii) you successfully refer a minimum of three (3) persons (each a “Referee” and together the “Referees”) to the Bank to successfully sign up for a GXS FlexiCard account using your referral code during the Promotion Period.
Such existing GXS FlexiCard account holder shall be referred to as the “Introducer”.
b. You will not eligible for this Promotion if:
(i) at any time, you’ve breached any of the Terms or the Card Account Terms or your GXS FlexiCard account has been blocked, terminated, suspended or is under investigation;
(ii) the requirements in Clause 2(a) above have not been met; or
(iii) the Referee had closed his or her GXS FlexiCard account in the last 6 months from the date the referral code is being used and reapplied for such GXS FlexiCard account during the Promotion Period.
c. Without prejudice to this Clause 2, a referral will be considered successful if:
(i) the eligibility requirements in Clause 2(a) have been met;
(ii) the Bank receives the Referee’s GXS FlexiCard application via the Introducer’s referral code (which is valid and existing) during the Promotion Period which has been sent to the Introducer through official GXS communication channels;
(iii) it is made in compliance with the Personal Data Protection Act 2012.
d. The date of referral shall be determined as the date on which the Bank receives the Referee’s GXS FlexiCard application via the Introducer’s referral code.
e. Without prejudice to these Terms, the Bank shall retain the sole and absolute discretion to determine any person’s eligibility under any GXS FlexiCard application or this Promotion for any reason without liability, including (but not limited to) if the Bank determines at its sole discretion that an Introducer or Referee has not complied with or has breached any of the Terms or the Card Account Terms and/or otherwise due to any misrepresentation, misconduct, fraud and/or unfair or illegal conduct exhibited by any person at any time.
a. Under this Promotion, an Introducer is eligible to earn a Bonus Cashback in addition to the referral cashback offered under the Refer for Rewards Campaign (October to December 2024) under the GXS Bank Q4 Brand Campaign. b. Bonus Cashback: If the Introducer has successfully referred three (3) or more Referees, the Introducer will receive a bonus cashback of S$10 cashback (“Bonus Cashback”) for each successful referral capped at the 10th successful referral.
Example: The Introducer made 11 successful referrals under this Promotion. The Bonus Cashback will be 10 x S$10 cashback. If the Introducer only made 2 successful referrals under this Promotion, the Introducer will not be eligible for any Bonus Cashback.
c. If more than one Introducer refers the same Referee to the Bank during the Promotion Period under this Promotion, the Introducer whose referral code is first used by the Referee in his or her successful application will be eligible to receive the Bonus Cashback. The use of such referral code shall be final and conclusive.
d. A Referee is only allowed to use a referral code once and cannot use multiple referral codes.
a. By referring any Referee to the Bank or sending any Bank-issued referral code to any Referee, the Introducer:
(i) consents to the Bank disclosing information on the Introducer and the fact that such Introducer holds a GXS FlexiCard account to the Referee for purposes of or in connection with this Promotion;
(ii) agrees and confirms that he or she has prior to referring any Referee already informed and obtained the consent of the Referee to collect, disclose and use the Referee’s personal data for the purposes of or in connection with this Promotion and that certain information relating to the Referee’s GXS FlexiCard application may be disclosed to the Introducer by virtue of whether or not such Introducer receives a Bonus Cashback; and
(ii) agrees and confirms that he or she has prior to referring any Referee already informed and obtained the consent of the Referee to the Bank’s representative contacting them via phone, message and/or electronic mail for the purposes of or in connection with this Promotion.
b. By using any Bank-issued referral code to apply for a GXS FlexiCard account underthis Promotion, the Referee agrees, confirms and consents:
(i) to the Bank collecting, disclosing and using his or her personal data for the purposes of or in connection with this Promotion and that certain information relating to the Referee’s GXS FlexiCard application may be disclosed to the Introducer; and
(ii) to the Bank or any Bank representative contacting them via phone, message and/or electronic mail.
a. Bonus Cashback is issued on a first-come-first-served basis and is limited to the first 1000 eligible Introducers. For the avoidance of doubt, an eligible Introducer is an Introducer who has met the eligibility criteria set out in these Terms.
b. For Introducers who hold both a GXS Savings Account and a GXS FlexiCard account, the Bonus Cashback shall be credited into the Main Account of your GXS Savings Account on or before 28 February 2025. For Introducers who only hold a GXS FlexiCard account, the Bonus Cashback shall be credited to your GXS FlexiCard account on or before 28 February 2025. The crediting of your Bonus Cashback is subject to your applicable GXS Bank accounts being active, in good standing and not having been cancelled, closed, blocked, terminated, suspended or under investigation at the point of fulfilment and crediting.
c. Introducers must ensure they successfully open a GXS Savings Account by 1 February 2025 if they want the Bonus Cashback to be credited into their GXS Savings Account.
d. If we are unable to credit the Bonus Cashback to your GXS Savings Account or GXS FlexiCard for whatever reason, the Bonus Cashback that has yet to be credited will be forfeited in full.
e. Cashback is not exchangeable for cash, credit or any other items, and cannot be transferred or assigned.
f. The Bank reserves the right to replace, exchange, vary or substitute any Cashback with an item(s) of equivalent value at its sole discretion without prior notice or reason and without liability to any person(s).
g. If the Bank at any time determines at its sole and absolute discretion that any of the requirements of the Promotion were not met or complied with, the Bank reserves the right to recover any or all Bonus Cashback (or its equivalent value) by deduction from your GXS Savings Account or any account you maintain with us.
a. Unless otherwise stated, this Promotion is not valid with other offers, discounts, rewards, vouchers or promotions. For the avoidance of doubt, all customers may participate in this Promotion and all other GXS Bank campaigns that are running during the Promotion Period if they have complied with the applicable terms and conditions thereunder, unless otherwise stated.
b. The Bank may add to, amend, modify or vary any or all of these Terms or terminate, extend or shorten the Promotion at any time without notice or liability to any person.
c. The Bank’s records and decisions on all matters relating to the Promotion (including but not limited to the eligibility of any person to participate in the Promotion and the offer of any approval with respect to the GXS FlexiCard) shall be final, conclusive and binding on all customers. We are not obliged to entertain any correspondence.
d. In the event of any inconsistency between these Terms and any brochure, marketing or promotional materials relating to the Promotion, these Terms shall prevail.
e. These Terms shall apply in conjunction with the Card Account Terms and the Rewards Terms and any other relevant terms as may be updated and/or notified by the Bank from time to time.
f. The Bank, employees and/or independent contractors shall not be liable for any loss, liability, expense, damage and/or injury whatsoever or howsoever incurred or sustained by any person by reason of, arising from or in connection with the Promotion including the redemption or use of any good, service, product or facility of any merchant (if applicable) or for any other reason.
g. The Bank is not responsible for any failure or delay in the transmission of any transaction by any party, including acquiring merchants, merchant establishments or any telecommunication provider.
h. These Terms shall be governed by and interpreted in accordance with Singapore law, and you agree to submit to the exclusive jurisdiction of the Singapore courts.
i. A third party who is not a party to these Terms shall have no rights under the Contracts (Rights of Third Parties) Act 2001 of Singapore to enforce or enjoy the benefit of any provision of these Terms.
j. The Bank reserves the right to reject any application, suspend, terminate or close any GXS FlexiCard Account and/or change or vary any term of the GXS FlexiCard offered (including the credit limits and any fees/rates) at its sole and absolute discretion, including but not limited to if the Bank determines (at its sole discretion) that any person has not fulfilled the terms of the Promotion and/or otherwise any misrepresentation, misconduct, fraud, and/or unfair or illegal conduct has been exhibited on the part of any person at any time.
k. The Bank reserves the right, at its sole and absolute discretion, to suspend, discontinue, extend and/or otherwise terminate this Promotion at any time without notice. The Bank shall not be liable for any damages, losses, claims or expenses arising from the suspension, discontinuance, extension and/or termination of the Promotion.
